The Odisha Labour Department has issued a notification permitting women to work night shifts in various companies and commercial hubs, as long as they express their agreement.
According to a Labour Department statement, women can work night shifts in industries and commercial businesses if they provide a consent letter. At least three female employees must be present in the workplace, and a female supervisor must be available to oversee their work.
The Odisha government has made substantial modifications to the Odisha Shops and Commercial Establishments Act, 1956, including removing limitations on women working night shifts in private businesses. The amendment removes the earlier Clause 23, which previously limited female employment during nighttime hours. With this revision, women are now allowed to work night shifts in various establishments, providing them with greater flexibility and opportunities in their careers.
According to the notification, employees are required to take special precautions to protect their female employees. Employers must provide GPS-enabled vehicles for pick-up and drop-off services or arrange safe accommodation close to the workplace to improve commuter safety. Drivers of these vehicles will be police verified to verify their credibility.
Furthermore, employers are obligated to follow certain safety regulations to provide a safe environment for women working night shifts. This involves keeping the facilities well-lit to increase visibility and prevent potential attacks. Additionally, employers must install CCTV surveillance to monitor and record activities, thereby improving overall safety and security.
Employees must have access to basic facilities such as drinking water and clean restrooms in order to maintain their health and well-being.
Furthermore, workplaces must display specialized helpline numbers, such as 181 (the state women’s helpline) and 1800-345-6703 (the Labor Department’s helpline), to give women with rapid support and assistance in the event of an emergency or issue. These hotline numbers must also be conspicuously placed inside employee transportation vehicles.
However, the announcement made it clear that the night shift relaxation does not apply to minors, assuring their safety and protection under existing labor rules. The emphasis remains on providing a safe and friendly workplace for women while protecting their rights and dignity.
