The Revenue and Disaster Management Department has implemented a new Standard Operating Procedure (SOP) to improve the registration of portion plots throughout the state.
The SOP intends to provide the public with uniformity, openness, and convenience of life by overriding all previous norms. The move corrects inconsistencies among Registering Officers and offers clear guidelines under the Registration Act of 1908 and the #Odisha Registration (Amendment) Act, 2013.
Revenue and Disaster Management Minister Suresh Kumar Pujari introduced the SOP in response to numerous Registering Officers’ lack of awareness of the laws and procedures for part plot registrations, with the goal of improving uniformity and public convenience.
“As per Sections 21 and 22 of the Registration Act, 1908, read with Rule 147 of the Odisha Registration Rules, 1988, Registering Officers shall accept any non-testamentary deed relating to immovable property that provides a sufficient description of the property, enabling its identification through a map and the four boundaries of the sub-divided plot”, read the new SOP issued by the Revenue and Disaster Management Department.
“Under Section 22-A(1)(c) of the Registration (Odisha Amendment) Act, 2013, Registering Officers shall refuse registration of any instrument relating to transfer of immovable property where such transfer where such transfer or alienation is prohibited under any State or Central Act”, the SOP clarified.
Rural Area Provisions: Registration of part plots in rural regions is permitted without restrictions, with the exception of Jalasaya Kissam plots, which must be transferred as full plots with sub-divisions of no more than 500 square meters.
Agricultural Plots: Sub-division is permissible if the plot remains agricultural Kissam, as evidenced by a self-declaration in ‘Form D’ verifying agricultural use only.
Urban and planned areas are governed by the Odisha Development Authorities and Town Planning Acts, with exceptions for family sub-divisions, tiny sub-divisions (less than 500 square meters and no real estate use), and co-sharer divisions (with agreement and proportionate shares).
Pre-Existing Small Plots: Sub-division of plots under 500 square meters recorded before to the 2025 ODA, OTP, and IT Second Amendment Rules is permitted without regard to other legislation.
Officer Instructions: Registering Officers shall examine maps, borders, and declarations, monitor exemption compliance, and keep records of self-declarations.
